Accidents Involving Children

You should be aware of a few key points relating to compensation claims for accidents involving children.

Firstly, whilst most claims for compensation will time-bar 3 years from the date of an accident, in the case of a child, the case does not time-bar until 3 years after their 16th birthday.  In other words, any claim will time-bar on their 19th birthday.

Secondly, assuming that there is a sound legal basis for the claim, a child (under age of 16) will always be entitled to legal aid.  As a parent or guardian you can instruct Sandgate Law to act for you on behalf of the child.  This will include raising a court action if a settlement can’t be negotiated.

Thirdly, depending on the age of the child, the law expects a very high standard of reasonable care to be applied to reduce the risk of accidents and injury to children.
